TWO TYPES OF BANKRUPTCY

  • Chapter 7 is the simplest type of bankruptcy.  For people who qualify under this Chapter, the bankruptcy laws offer many exemptions to protect your home, car and other property.  At the same time, a Chapter 7 bankruptcy will discharge your obligation to pay debts which you can no longer afford.  Individuals who file for Chapter 7 bankruptcy protection typically receive a discharge about four months after filing.  During our initial consultation, we will determine whether you qualify for Chapter 7.  I will apply my knowledge and experience to maximize the protection of your property through the bankruptcy exemptions.

  • Chapter 13 of the Bankruptcy Code is for people whose income, assets or other circumstances prevent them from filing for Chapter 7 protection.  A Chapter 13 plan provides another method to protect your property while eliminating debts which you can no longer afford to pay.  The plan may also provide a structured, affordable way to pay certain non-dischargeable debts such as taxes or domestic support arrearages
